1. Acceptance of Terms
1.1 These Terms govern your access to and use of BabySleepBot™, an online service for baby sleep training. By accessing or using the service, you accept these Terms in full.
1.2 By contacting Jennifer or anyone in the BabySleepBot™ team directly for additional advice or consultation, including but not limited to filling in assessment forms or communicating information through online means, you agree that all terms and conditions outlined in this document extend to such interactions. This includes, but is not limited to, provisions regarding the limitation of liability, indemnification, data privacy, and intellectual property. Any advice or consultation provided by Jennifer is subject to these Terms, and by seeking such advice, you acknowledge and accept these conditions in full.
2. Description of Service
2.1 BabySleepBot™ provides educational materials, audio clips, and interactive AI chatbot assistance designed to aid in baby sleep training.
2.2 The service is accessible online through payment with a fixed term of 60 days following payment.
3. Registration and Account Integrity
3.1 To access the service, you must register for an account, which involves submitting personal information and contact details.
3.2 You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
3.3 You must provide accurate and complete information during registration and promptly update any information to keep it accurate and complete.
4. Fees and Payments
4.1 Payment is required to access BabySleepBot™ and payable in advance. The specific fees and payment options will be outlined during the registration process.
4.2 Fees are non-refundable due to access being provided to proprietary information and intellectual property. By joining the program through payment, you agree to fees being non-refundable.
4.3 You agree to provide current, complete, and accurate billing information for all purchases.
5. User Conduct
5.1 You are prohibited from using BabySleepBot™ in any way that:
Causes, or may cause, damage to the service or impairment of the availability or accessibility of the service.
Is unlawful, illegal, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.
Copies, stores, hosts, transmits, sends, uses, publishes, or distributes any material that consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit, or other malicious computer software.
5.2 You agree not to engage in any conduct that restricts or inhibits any other user from using or enjoying the service.
6. Content
6.1 The service allows users to post and exchange opinions and information in certain areas of the website. BabySleepBot™ does not filter, edit, publish, or review comments prior to their presence on the website.
6.2 Comments do not reflect the views and opinions of BabySleepBot™, its agents, or affiliates.
6.3 You agree to use the content provided for lawful purposes only and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use and enjoyment of the service.
7. Intellectual Property Rights
7.1 The service and its original content, features, and functionality are owned by BabySleepBot™ and are protected by international copyright and trademark laws.
7.2 You are granted a limited license only for purposes of viewing the material contained on this service.
7.3 Any unauthorised use of the content may violate copyright, trademark, and other laws.
8. Termination
8.1 We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
8.2 Upon termination, your right to use the service will immediately cease.
9. Limitation of Liability
9.1 BabySleepBot™ will not be liable for any indirect, consequential, or special liability arising out of or in any way related to your use of this service.
9.2 In no event shall BabySleepBot™ or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on BabySleepBot’s website.
9.3 BabySleepBot™ team and its affiliates, expressly disclaim any responsibility or liability for any adverse outcomes, issues, or injuries that may occur to either the parent or the baby during the sleep training process. By participating in the BabySleepBot™ sleep training program, you acknowledge and agree that you are solely responsible for monitoring your baby’s health and well-being, as well as ensuring that all advice and strategies provided are suitable for your baby’s specific needs. You understand that sleep training methods and recommendations are intended to be used as guidelines and should not replace professional medical advice. In the event of any concerns or complications, it is imperative to seek immediate consultation with a qualified healthcare provider. BabySleepBot™ will not be held liable for any direct, indirect, incidental, special, or consequential damages arising from your participation in the program.
10. Indemnification
10.1 You hereby indemnify BabySleepBot™ from and against any and/or all liabilities, costs, demands, causes of action, damages, and expenses arising in any way related to your breach of any of the provisions of these Terms.
10.2 You agree to defend, indemnify, and hold harmless BabySleepBot™ and its affiliates, licensors, and service providers from any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the service.
11. Severability
11.1 If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.
12. Variation of Terms
12.1 BabySleepBot™ is permitted to revise these Terms at any time as it sees fit, and by using this service you are expected to review these Terms on a regular basis.
12.2 Changes to these Terms will be effective when posted on this page, with an updated effective date.
13. Assignment
13.1 BabySleepBot™ is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification or consent required.
14. Entire Agreement
14.1 These Terms, including any legal notices and disclaimers contained on this website, constitute the entire agreement between BabySleepBot™ and you in relation to your use of this service.
15. Governing Law & Jurisdiction
15.1 These Terms will be governed by and interpreted in accordance with the laws of the state and country in which BabySleepBot™ is registered, and you submit to the non-exclusive jurisdiction of the state and federal courts located there for the resolution of any disputes.

Additional Specific Terms for BabySleepBot™ Services
17. BabySleepBot™ Program Terms
17.1 Confirmation of Baby’s Eligibility: The client confirms that their baby is over four months old (16 weeks corrected), weighs at least six kilograms, is healthy, and is developmentally on track.
17.2 Consultation with Healthcare Provider: The client agrees to consult with their healthcare provider or doctor to ensure their baby can safely participate in the sleep training program, especially if the baby has any medical conditions.
17.3 Safe Sleeping Practices: The client commits to following safe sleeping practices in accordance with SIDS recommendations (link).
17.4 Privacy Notice: By using the DIY sleep program for their baby, the client understands and agrees that it is strictly intended for their baby’s exclusive use and should not be disclosed to anyone else or any third parties. Sharing the intellectual property of BabySleepBot™ or any information pertaining to the course content will result in immediate expulsion from the course and further legal action.
17.5 Compliance with Recommendations: The client agrees to prioritise and implement the provided sleep recommendations for their baby, including understanding the key components of the sleep training program.
17.6 No Interference with Sleep Training: The client understands that during the sleep training program, they should refrain from planning any nights away, holidays, or outings that would significantly disrupt their baby’s sleep.
17.7 Limited Guarantee: While the program aims to provide effective sleep training methods, specific results cannot be guaranteed. The success of the program may vary based on individual circumstances and parental consistency.
17.8 Duration of Program: The client will have access to the DIY program for a period of two months (60 days) from the date of purchase.
17.9 Client Responsibilities: The client agrees to actively participate in the sleep training program by following the provided instructions and consistently implementing the recommended strategies. Failure to adhere to the program may impact its effectiveness.
17.10 Confidentiality and Privacy: Both parties agree to maintain the confidentiality of any personal and sensitive information shared during the program, in compliance with applicable privacy laws.
17.11 Copyright and Intellectual Property: All materials, content, and intellectual property provided as part of the DIY program are owned by the BabySleepBot team and are for the client’s personal use only. Any unauthorised distribution, reproduction, or sharing of the materials may result in legal action.
17.12 Amendments: BabySleepBot team reserve the right to amend the Terms of Use at any time and that any changes will be effective upon posting the updated terms on the website or through other means of communication.
18. BabySleepBot™ Chatbot Feature Terms
18.1 The use of the BabySleepBot™ chat bot feature aims to assist clients with their questions. However, please note that the chatbot is an automated system and may occasionally provide incorrect answers due to its computerised nature. If an answer seems incorrect, clients should disregard it and utilise the “report answer” feature to contact BabySleepBot team who will review and edit the response for future users’ accuracy and appropriateness.
18.2 Client Responsibility: Clients bear the responsibility to exercise their own judgment and discretion when using the BabySleepBot™ chat feature. While BabySleepBot strives to provide accurate and helpful information through the chatbot, clients understand that they should not solely rely on the chatbot’s responses for critical decisions regarding their baby’s health or well-being.
